What this site is

OCTAVA is a property listings portal for the eight Canary Islands. Its function is to host and organise listings published by third parties — estate agencies, advisers and independent consultants — and make them available to the public.

OCTAVA is not a party to any sale or lease. It does not provide estate agency services, does not represent buyers or sellers, takes no part in negotiation or signing, and receives no commission on transactions. Its commercial relationship is exclusively with the advertiser, who pays to publish.

The calculators on the portal — mortgage, annual cost of ownership, holiday-rental quota checker and valuation tool — are indicative. They do not constitute financial, tax, planning or legal advice, and none of them replaces consulting the relevant professional or public authority.

The valuation is not a formal appraisal

The value estimate offered by the portal is a statistical calculation based on comparables and public price series. It is not an appraisal and has no validity for mortgage, tax or judicial purposes. An appraisal with legal effect may only be issued by a company approved by and registered with the Bank of Spain, under Royal Decree 775/1997 and Orden ECO/805/2003.

Third-party content and its verification

Listings are produced and published by advertisers, who are responsible for their accuracy, lawfulness and currency, and for holding sufficient title or mandate over the property advertised.

OCTAVA verifies the advertiser’s identity and the property’s cadastral reference against documents before publishing. That verification does not make the portal the author of the content, nor does it imply that every statement in a listing has been checked.

Reporting illegal content

Any person or entity may report content they consider illegal through the mechanism available in the footer of every page, under Article 16 of Regulation (EU) 2022/2065 (Digital Services Act). No account is required. Every report receives an acknowledgement with a reference, and the decision on the content is communicated with reasons and with the available redress options.

The single point of contact for authorities and for recipients of the service, for the purposes of Articles 11 and 12 of the same Regulation, is the email address above. Languages of communication: Spanish and English.

Intellectual and industrial property

The OCTAVA trade mark, the logo, the site design, the portal’s own texts, the island guides and the software belong to the provider or are used under licence. Listings, photographs, floor plans and videos belong to each advertiser, who authorises the portal to reproduce and communicate them publicly while the listing is active.

Systematic extraction of the site’s content, by automated or manual means, is prohibited without written authorisation.

Liability

The provider is not liable for damage arising from the use of information published by third parties, from temporary unavailability of the service, or from the content of sites linked from the portal.

None of the above excludes liability that is mandatory under consumer protection law, or liability arising from wilful misconduct or gross negligence.

Governing law

This notice is governed by Spanish law. For disputes with users who are not consumers, the parties submit to the courts of the provider’s domicile. Where the user is a consumer, the forum established by applicable mandatory law shall apply.

These texts are published in Spanish and English. In case of discrepancy the Spanish version prevails. The portal’s other language versions link to the English one.

PROTOTYPE. There is no company behind this site and the identity fields appear in brackets, unfilled: a legal notice with an invented tax ID would be a document that appears to identify a real party. Before going live these must be completed and all four texts reviewed by a qualified lawyer.
